What data we process

We process the data you provide through the contact form and the AI chat assistant (Penny): name, email, phone and the content of the messages you send us. The server also logs your IP address for security and abuse prevention. We do not collect special categories of data nor build profiles for advertising purposes.

Purpose and legal basis

Purpose: to handle and manage your enquiries, provide the information requested and, where applicable, take steps prior to a possible contractual relationship.

Legal basis: your consent, given when you submit the form or start the chat, and the taking of pre-contractual measures at your request (Art. 6.1.a and 6.1.b GDPR).

Processors

Your data may be processed by the following processors, under a data-processing agreement pursuant to Art. 28 GDPR:

1. SYSBalear (own hosting): web and email hosting on SYSBalear's own servers located in the EU/Spain.

2. AI infrastructure provider: when you use the AI assistant (Penny), the text of your conversation is sent to the platform of our AI infrastructure provider to generate the reply. This provider acts as a processor under a data-processing agreement, does not use the data for advertising profiling, and you can request its identity by writing to info@sysbalear.com.

3. Microsoft 365 / Office: where applicable, management of the email through which enquiries are received and handled.

No data is sold or shared for advertising purposes.

Retention

We keep your data for as long as the relationship or interest in your enquiry is maintained and, afterwards, for the legally required periods to address possible liabilities. Chat conversations are kept for a limited period for their management and are deleted once that period has elapsed; the contact details you provide are kept to process your enquiry.

International transfers

Hosting takes place on servers located in the EU/Spain. However, using the AI assistant (Penny) may involve a transfer of the conversation text outside the EEA, since our AI infrastructure provider is based in the United States. This transfer is covered by appropriate safeguards under the GDPR (Standard Contractual Clauses pursuant to Art. 46 GDPR).

The AI assistant (Penny)

This site offers a conversational assistant (Penny) to answer your enquiries about SYSBalear. When you use it, we process what you type and, if you provide them, your name, email and phone, to handle your request and be able to contact you. The conversation text is processed through our AI infrastructure provider to generate the reply, as stated above. We use only essential local storage (a chat session identifier) to keep your conversation while you use it; we use no tracking cookies. You can request deletion of your conversation by writing to info@sysbalear.com. Your use of the website and the chat is also governed by the Legal Notice.

Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to info@sysbalear.com. You also have the right to withdraw your consent at any time and to lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).
